This Privacy Policy explains how your personal information is collected, used, and protected when you visit gabescalifornia.com (the “Site”) or join our waitlist or mailing list.

Who we are (Data Controller)

Gabe’s California is a brand operated by E-MTM Communications, the data controller responsible for your personal information.

What we collect and why

Information you give us. When you join our product waitlist or newsletter, we collect your email address and, optionally, your first name. If you choose to receive broader marketing updates, we record that separate opt-in. We keep a record of your consent (date, and the form you used) as proof that you agreed.

Information collected automatically. Like most websites, our hosting and security systems automatically log limited technical data (such as IP address, browser type, and pages visited) to keep the Site secure and working. We may review aggregate, non-identifying statistics about Site traffic.

We do not collect more than we need, and we do not sell your personal information.

Legal basis for processing

  • Consent: for sending you waitlist notifications and marketing emails. You may withdraw consent at any time (see “Your rights”).
  • Legitimate interests: for operating, securing, and improving the Site.
  • Legal obligation: where we must keep certain records (for example, proof of consent, or tax records).

Email and the waitlist

We use Brevo (operated by Sendinblue SAS, an EU-based company) to manage our waitlist and send emails on our behalf. Brevo acts as our data processor and stores your contact details securely. When you sign up, we use double opt-in, you must confirm via a link we email you before we add you.

Every marketing email includes a one-click unsubscribe link and our business mailing address. You can unsubscribe at any time, and we will stop sending you marketing messages.

Our marketing emails are designed to comply with the major anti-spam laws in the regions we serve, including the US CAN-SPAM Act, Canada’s CASL, the UK’s PECR, Australia’s Spam Act, New Zealand’s Unsolicited Electronic Messages Act, Japan’s specified-email law, and GDPR/UK GDPR consent rules. In practice this means we only email you after your confirmed opt-in, we clearly identify ourselves, and every message carries a one-click unsubscribe.

Cookies and similar technologies

The Site uses a small number of cookies necessary for performance and security (for example, caching and content-delivery). Embedded YouTube videos are served in privacy-enhanced mode, which avoids setting YouTube cookies until you click play. We do not use cookies to build advertising profiles of you.

Who we share your data with

We share personal information only with service providers who help us run the Site and communicate with you, under agreements that require them to protect it:

  • Brevo (Sendinblue SAS): email/waitlist management
  • Our hosting provider (JetHost): website and email hosting
  • Cloudflare: content delivery and security
  • YouTube / Google: only when you interact with embedded videos

If you buy merchandise, checkout takes place on our print partner’s platform (Spreadshirt), which handles your payment and order information under its own privacy policy. We do not receive or store your payment card details.

We may also disclose information if required by law, or to protect our rights, safety, or property.

International transfers

Because our audience is international, your information may be processed in the United States, the European Union, and other countries where we or our service providers operate (our email provider Brevo is based in the EU). Where required by law, we rely on appropriate safeguards, such as standard contractual clauses or equivalent mechanisms, for these cross-border transfers.

How long we keep your data

We keep your waitlist and marketing contact details until you unsubscribe or ask us to delete them, after which we remove them promptly (we may keep a minimal suppression record so we don’t email you again by mistake). Technical logs are kept only as long as needed for security and operations.

Your rights

Depending on where you live, you have some or all of the following rights over your personal information:

  • Access: request a copy of the data we hold about you
  • Correction: ask us to fix inaccurate data
  • Deletion / erasure: ask us to delete your data (GDPR Article 17; California CCPA/CPRA)
  • Portability: receive your data in a portable format
  • Withdraw consent / opt out: unsubscribe or object to marketing at any time
  • Non-discrimination: we will not treat you differently for exercising these rights

To exercise any right, email privacy@gabescalifornia.com or write to the mailing address above. We will respond within the timeframe required by applicable law. We do not sell or “share” your personal information as those terms are defined under California law.

Your rights across regions (our global audience)

Gabe’s California serves, and is actively growing, an international audience, including the United States, Latin America and Brazil, Canada, the United Kingdom, the European Union, Australia, New Zealand, and Japan. This Policy is written to meet the core requirements of the major privacy and anti-spam laws in these regions, and the rights described above apply to you wherever you live. Those frameworks include:

  • European Union / EEA: GDPR
  • United Kingdom: UK GDPR and the Data Protection Act 2018
  • Brazil & Latin America: Brazil’s LGPD (and comparable laws in Argentina, Mexico, Chile, Colombia, Peru, Uruguay, and others)
  • Canada: PIPEDA, Quebec’s Law 25, and CASL (anti-spam)
  • Australia: the Privacy Act 1988 / Australian Privacy Principles, and the Spam Act 2003
  • New Zealand: the Privacy Act 2020
  • Japan: the Act on the Protection of Personal Information (APPI)
  • United States: California’s CCPA/CPRA and the federal CAN-SPAM Act

If your local law grants you a right not listed above, contact us and we will honor it to the extent it applies.

Children’s privacy

The Site and our waitlist are not directed to children under 16, and we do not knowingly collect personal information from anyone under 16. Our signup asks you to confirm you are 16 or older. If you believe a child has provided us personal information, contact privacy@gabescalifornia.com and we will delete it promptly.

Business transfers

If E-MTM Communications is involved in a merger, acquisition, reorganization, or sale of assets (including a transfer to a commonly owned company), your personal information may be transferred as part of that transaction. We will ensure any successor continues to protect your information consistent with this Policy.

Changes to this policy

We may update this Policy from time to time. When we make material changes, we will update the “Effective date” above and, where appropriate, notify you.
